1 The Heywire Platform (NOT A LAW FIRM)
"Heywire," "we," "us," or "our" refers to Heywire Inc., a limited liability company registered in the State of Washington. Heywire operates two products under this same platform and these same Terms: Echo Business, a multi-location feedback and guest-recovery tool for businesses, and Consumer Advocate ("Advocate"), a tool that helps individuals organize evidence and generate dispute correspondence. References to "Heywire" below apply to both products unless a section specifically calls out one product.
By creating an account or otherwise using Echo Business or Advocate, you provide explicit permission for Heywire to act on your behalf for the limited purposes described in your account settings and any campaign, case, or workspace you create. However, it is critical that you recognize the following:
Heywire is NOT a law firm. Neither Echo Business nor Consumer Advocate is a legal service. Use of Heywire does not create an attorney-client relationship. This service is NOT a replacement for a lawyer, proper legal advice, or the formal justice system.
Heywire's AI is designed to assist you in organizing, documenting, and automating communication, feedback intake, and dispute correspondence, but all decisions, the accuracy of any claims you submit, and the outcome of any campaign, case, or dispute remain your sole responsibility.
2 Privacy, Data Handling & Email Verification
Your privacy is paramount. Here is how we handle your data across both products:
- No AI Training on Your Data: We do not train our proprietary AI models on your personal data, campaign content, feedback submissions, guest messages, or evidence, for either Echo Business or Consumer Advocate.
- Data Deletion: You have the right to request that your data be permanently deleted from our systems. Upon request, we will erase your account and all associated campaign, case, or workspace data, subject to any records we are required to retain by law.
- Unilateral Processing Right: You acknowledge and agree that Heywire reserves the right to process, review, and analyze your account and campaign data unilaterally — including for fraud prevention, abuse investigation, quality assurance, and platform safety — without requiring your separate authorization for each instance.
Email Verification. Every email address associated with a Heywire account is verified. When you sign up, submit feedback through an Echo QR, or start a case in Advocate, we send an authentication link to the email address provided, and that address is not treated as verified on our systems until you click that link. Any email we send that identifies itself as coming from "Heywire" has been sent from a verified, authenticated Heywire system — we do not sell, rent, or otherwise supply unverified email addresses to third parties.
While we use advanced AI to process your submissions, Advocate users drafting a campaign may wish to use a pseudonym or placeholder name at first. You have full ability to edit and add your specific personal details before sending final campaign documents.
3 User Conduct & Acceptable Use Policy
You agree to use Heywire, Echo Business, and Consumer Advocate responsibly. We enforce a zero-tolerance policy against abuse of our platform.
⚠️ Sexually Explicit Content: You must not submit, generate, or send sexually explicit images or content through Heywire, Echo, or Advocate. Violation will result in immediate flagging, account suspension, and an automatic report to your local authorities.
Harassment & Fraud Campaigns: You must not use Advocate or Echo to create harassment campaigns or fraudulent campaigns. This includes campaigns, feedback, or disputes launched with no evidence, no proof of wrongdoing, or initiated with malicious intent.
⚠️ Falsifying Information: Falsifying information, evidence, identity, or charges submitted through Heywire — including in an Echo feedback submission, an Advocate case, or a billing dispute — may open you up to legal action at the local, state, and federal level, in addition to immediate account termination.
We reserve the right to pause, remove, or suspend any campaign, feedback location, workspace, user, or account immediately and without notice for breaches of these terms or any form of abuse of Heywire, Echo Business, or Consumer Advocate.
4 Investigation Urgency & Wrongdoing
People or businesses targeted wrongfully by an Advocate campaign, or affected by misuse of an Echo location or workspace, can email terms@heywr.com.
We will pause the campaign or workspace in question and investigate the matter immediately and with extreme urgency. Heywire is committed to swift and severe penalties for wrongdoers who attempt to weaponize our platform.
5 Cooperation with Law Enforcement
We value user privacy, but we will cooperate with legal authorities when required by law. As a standard policy, we do not proactively share user information with law enforcement.
However, if we receive a valid legal subpoena or warrant, we will comply. In such events, we will communicate with the affected user first before disclosing any information, provided it is not legally prohibited.
6 Echo Business — Additional Terms
The following terms apply specifically to your use of Echo Business, including any free-tier or paid workspace, location, or Echo QR.
- Verified Emails Only: Every email address collected through an Echo QR, embed, or link is routed through the same verification process described in Section 2 — a guest or customer's email is only recorded as verified once they click the authentication link sent to it. We do not provide unverified emails to Echo customers.
- We Do Not Read Your Messages: Heywire does not read the content of guest or customer messages submitted to your Echo inbox in the ordinary course of business.
- Reserved Right to Investigate: If a complaint is launched against an Echo customer's account, location, or workspace — whether by a guest, a third party, or a payment processor — Heywire reserves the right to access the relevant messages, contact Echo support on the account, and remove, suspend, or restrict the location or workspace in question while the matter is investigated.
- Annual Plans: Echo Business Pro is billed on an annual basis. Subscriptions are per-location and auto-renew each year unless canceled prior to the renewal date.
- Verification for Account Changes: To protect Echo customers from unauthorized account changes, we require an EIN, Tax ID, or a Government ID to verify the identity of the business requesting certain account actions, including opt-outs described in Section 9.
- Closed or Closing Locations: If an Echo location is closing permanently, has entered bankruptcy, or is subject to a judicial order, the customer must submit the applicable lease-end notice, bankruptcy filing, or judicial notice to Heywire for authentication before any location-level adjustment is processed. A letter from a landlord alone does not satisfy this requirement and will not be accepted as sole documentation.
7 Consumer Advocate — Additional Terms
The following terms apply specifically to your use of Consumer Advocate, including Basic, Pro, and Concierge campaigns.
- Accuracy of Your Case: You are solely responsible for the accuracy of the facts, documents, and evidence you upload to a campaign. Advocate organizes and drafts correspondence based on what you submit; it does not independently verify your claims before sending them.
- Identity Verification for Opt-Outs: To protect your identity, opt-out requests described in Section 9 require a written request, a valid email, and a picture ID before they will be processed.
- Bank & Payment Disputes: If you initiate a dispute, chargeback, or reversal with your bank or card issuer over an Advocate charge, Heywire reserves the right to immediately suspend and cancel your Advocate account pending resolution of that dispute.
8 Billing, Renewals & Refunds
Unless otherwise agreed upon in writing or explicitly stated at the time of purchase, there are no refunds for Heywire, Echo Business, or Consumer Advocate services.
Echo Business renewals: Echo Business Pro subscriptions are billed yearly and auto-renew automatically. It is your responsibility to contact us prior to your renewal date if you do not wish to renew. While we may send reminder notifications as a courtesy, we do not guarantee that a reminder will be sent for every customer ahead of every renewal — customers should reach out to their account manager or check their billing dashboard to confirm their renewal date. If auto-renewal is processed, no refund will be given for that billing cycle.
Closed-location exception: if an Echo location closes permanently and the required documentation described in Section 6 is authenticated, we may process a refund for that specific location's remaining term. This does not extend to a refund of the customer's entire Echo account or its other active locations.
Bank disputes suspend service: As noted in Sections 6 and 7, initiating a bank or card dispute over a Heywire charge — for either Echo Business or Consumer Advocate — gives us the right to immediately suspend and cancel the associated account (and, for Echo, all locations on that account) while the dispute is resolved.
If you believe you were charged in error, please contact us at terms@heywr.com and we will review your case within 5 business days.
9 Marketing, Testimonials & Product Development
By using Echo Business (on any tier) or Consumer Advocate, you agree that Heywire may:
- Feature your business, workspace, situation, results, or likeness in digital marketing materials, including on our website, social channels, and advertising;
- Use AI-generated visuals or dramatizations to tell real user or customer stories and outcomes, based on your account or case activity; and
- Use your information, business details, situation, or likeness internally for testing, quality assurance, and product development.
You may opt out of appearing in HeyJoy (see Section 10) and any digital marketing or media campaign at any time by contacting us in writing and requesting it. Advocate users must submit their request by email along with a picture ID; Echo customers must submit their request along with an EIN or Tax ID, so that we can verify the identity of the person requesting removal on behalf of the account or business.
10 HeyJoy & Related Services
HeyJoy is a "doing business as" (DBA) name of Heywire Inc. By using Heywire, you may receive notifications from HeyJoy. Echo Business customers — whether on the free or paid tier — may have their business listed as a service or venue within the HeyJoy app.
You can request to opt out of HeyJoy listings and notifications at any time using the identity-verified process described in Section 9.
11 Mediation & Waiver of Arbitration
By using Heywire, Echo Business, or Consumer Advocate, you waive your right to individual or class arbitration of any dispute arising out of or relating to these Terms or your use of the platform.
Instead, in the event of a dispute between you and Heywire, you agree to first seek resolution through mediation with Heywire Legal by contacting terms@heywr.com. Only if that mediation is unsuccessful may either party pursue further legal action, which shall be brought exclusively in the state or federal courts located in Washington State, and shall be governed by the laws of the State of Washington without regard to its conflict-of-laws principles.
12 Limitation of Liability & General Provisions
Heywire, Echo Business, and Consumer Advocate are provided "as is" and "as available." We do not guarantee the success of any campaign, feedback resolution, or dispute outcome. To the maximum extent permitted by law, Heywire Inc. and its officers, directors, employees, and agents are not liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the platform, the content you generate or submit, or the actions you or any third party take based on Heywire's outputs.
Indemnification: You agree to indemnify and hold harmless Heywire Inc. and its officers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the platform, your violation of these Terms, or your violation of any rights of a third party.
Changes to These Terms: We may update these Terms from time to time. Continued use of Echo Business or Consumer Advocate after changes are posted constitutes your acceptance of the revised Terms.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
Entire Agreement: These Terms, together with any product-specific policies referenced herein, constitute the entire agreement between you and Heywire Inc. regarding your use of Echo Business and Consumer Advocate.
By continuing to use Heywire, Echo Business, or Consumer Advocate, you acknowledge that you have read, understood, and agreed to these Terms & Conditions in their entirety.
